Specifically, information is considered particularly sensitive if it may reveal aspects such as racial or ethnic origin, state of present and future health, genetic information, religious, philosophical and moral beliefs, union membership, political opinions or sexual preferences. In case of staying at any of our hotels, sensitive personal data which we ask you to provide us will be that relating to health or different capabilities, and will be used only to provide you with better service and to meet your specific needs.
D. Purpose and Treatment of Personal Information
Purposes which give rise to the legal relationship and are necessary for the provision of service:
1. The personal information that you provide will be used by The Hotels to provide the services that you request or that are part of a program which you have registered for or for a purchase you made: reservations, purchase of vacation packages, affiliation to our loyalty programs, organization of events and social gatherings, purchase of products and/or tourism services.
2. The Hotels may use the personal information provided to us to offer you better service and, where appropriate, identify your preferences during your stay in order to make it more enjoyable.
Purposes that do not give rise to the legal relationship or are not necessary for the provision of service:
1. In addition, it may use the information to offer you promotions and business and tourism products, sending of promotions, special services, newsletters, surveys, prize drawings and other online contests.
E. Limitations to the Use or Disclosure of Personal Information
At any time you can express your rejection to the treatment of the purposes that do not give rise to the legal relationship or are not necessary for the provision of the service, or the revocation of consent that has given for the processing of your personal data, by means of a request which must be submitted in writing to the Department of Personal Data to the following address: Paseo Diaz Ordaz 901, Col. Centro, C.P. 48300, Puerto Vallarta, Jalisco, from 9:00 a.m. to 2:00 p.m. from Monday to Friday or via an e-mail to datos.personales@hotelrosita.com.
Said application must contain at least the following: (i) name of the holder of the personal data; (ii) e-mail address for receiving notifications; (iii) documents certifying your identity or, if applicable, the legal representation of the holder; (iv) clear and precise description of the personal data regarding which you are seeking to exercise the right and law that you intend to exercise; (v) any other element or document that facilitates the location of personal data. In case the application does not satisfy any of the requirements outlined above, the Department of Personal Data may require you, within 7 days of receipt of the request, to input elements or documents needed to process it. You will have 10 days to meet the requirements; if you do not respond within that period, you will have not filed the corresponding application.
Attention periods will have maximum of 20 days from the date of receipt of the request to inform you of the adopted determination to, if it is appropriate, make the same effective within 15 days of the issuance of the response. In order to protect your confidentiality, The Hotels will send the response to your request to the e-mail address you provided for this purpose and shall keep it at the disposal of the applicant at the address indicated in the previous paragraph.
F. Regarding the Exercise of the Rights of Access, Rectification, Cancellation and Objection.
Access, rectification, cancellation or objection with regard to the information you provide The Hotels mentioned in the Federal Law of Protection of Personal Data in the Possession of Individuals, can be done through the delivery of the request addressed to The Hotels, in terms of the provisions outlined in prior subsection E, which they will respond to in the terms outlined there.
G. Control and Security of Personal Information.
The Hotels are committed to take the necessary measures to protect the collected information, using security technologies and procedures of control of the access, use or disclosure of your personal information without authorization. If can of being asked for sensitive personal data, it will be used only for the purposes of the employment relationship.
